Missouri law requires all operators and passengers in any motor vehicle to wear seat belts. If you do not wear a seat belt, you can be given a citation since it a violation of Missouri law. The established fine for this is $10.00 and is a no-point ticket.
If you are involved in a Missouri car accident and are not wearing your seat belt, this can diminish your recovery. If the defense lawyer can show your failure to wear a seat belt contributed in causing your injuries through medical testimony, the jury can consider reducing your damages. However, under Missouri law, the most your damages may be reduced is 1%. If the defense lawyer cannot meet this burden, the fact you were not wearing your seat belt will not be admissible because it is irrelevant.
