They can aslo be referred to as a ROV (recreational off-highway vehicle). These are by definition meant to transport property and up to 6 passengers. They are usually larger and have a longer wheelbase than an ATV. UTVs are usually four-wheel drive.
An ATV (all-terrain vehicle) has two different classifications from the manufacturer. A Type I ATV is inteded for a single operator and no passengers. A Type II ATV is designed to have an operator and a passenger with appropriate seating for both.
Off-Highway vehicles (OHV) is a generalized term that includes ATVs, ROVs, and UTVs. They can also be referred to as MOHUV (multipurpose off-highway utility vehicles).
The differentiation between these various terms is very important because insurance companies define these vehicles within their policies to exclude coverage for serious injuries and death claims. Your ATV lawyer will need to review each policy and determine whether the vehicle is excluded from coverage.
The Consumer Product Safety Commission has issued a number of recalls for these off-road vehicles due to the rising number of side by side atv accidents. From 2010 to 2019, there were 92 recalls encompassing 19 different brands. The most recalled UTV was made by Polaris. In total, 28 recalls were issued for Polaris UTVs.
